4. Marketing Communications

We may send promotional communications when we have your consent or another lawful basis permitted by applicable law.

You may unsubscribe from marketing emails by using the unsubscribe link included in the message or by contacting us. Opting out of marketing does not prevent us from sending necessary transactional or service communications, including order updates, design approvals, shipping notices, security messages, or responses to your requests.

Where applicable law requires a legal basis, we may process personal information because:

  • Processing is necessary to enter into or perform a contract with you, including producing and delivering your order;
  • Processing is necessary to comply with a legal obligation;
  • You have provided consent, which you may withdraw where applicable; or
  • Processing is necessary for our legitimate interests or those of another party, such as operating and improving the Services, preventing fraud, securing our systems, providing customer support, and protecting legal rights, provided those interests are not overridden by your rights.

The legal basis that applies may vary depending on the information, purpose, and jurisdiction.

6. Shopify

Our store is hosted and supported by Shopify. Shopify provides services such as the storefront, checkout, hosting, payment-related functionality, security, and other commerce infrastructure.

Shopify may collect and process personal information when you visit the Site, interact with our store, or complete a transaction. Shopify processes that information according to its own privacy practices. You can learn more through the Shopify Consumer Privacy Policy and Shopify Privacy Portal.

If Shopify Network Intelligence or related enhanced services are enabled, Shopify may use information from interactions with participating Shopify merchants to provide or improve qualifying services. Available privacy controls will depend on applicable law and the settings enabled for our store.

7. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary:

  • Shopify and its affiliated service providers;
  • Payment processors and financial-service providers;
  • Product customization and design-application providers;

  • Accountants, attorneys, insurers, and other professional advisers;
  • Government agencies, regulators, courts, and law-enforcement authorities; and
  • Parties involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction.

Production partners may receive artwork, product specifications, and production instructions. Fulfillment providers and carriers may receive contact and delivery information. We seek to disclose only the information reasonably necessary for the relevant service.

We may also disclose information:

8. Sale, Sharing, and Targeted Advertising

We do not sell personal information for money.

However, depending on the technologies and Shopify services enabled for our store, certain disclosures to advertising or analytics partners may be considered a “sale,” “sharing,” or processing for “targeted advertising” under some U.S. state privacy laws.

Where these activities apply and applicable law provides an opt-out right, you may exercise that right through the “Your Privacy Choices” or “Do Not Sell or Share My Personal Information” link displayed on the Site, through an applicable browser-based opt-out signal, or by contacting us.

Where required by applicable law, we recognize and process applicable opt-out preference signals, such as the Global Privacy Control (GPC), through the privacy controls available on our storefront. The signal generally applies to the browser and device from which it is sent. If you use multiple browsers or devices, you may need to communicate the preference separately.

9. Cookies and Similar Technologies

We and our service providers use cookies and similar technologies for purposes including:

  • Keeping the Site and checkout functioning;
  • Maintaining sessions and shopping carts;
  • Remembering preferences;
  • Protecting accounts and preventing fraud;
  • Measuring traffic and site performance;
  • Understanding how visitors use the Site; and
  • Supporting advertising or personalization where permitted.

Some cookies are necessary for the Site to function and cannot be disabled through our cookie preference tool. Where required, non-essential analytics, advertising, or personalization technologies are used only after the required permission has been obtained.

You may manage available choices through the cookie banner or cookie preference controls displayed on the Site. You may also change browser settings to block or delete cookies, although doing so may affect certain Site features.

Cookie identifiers and related information may qualify as personal information even when they do not directly display your name.

10. Custom Artwork and Saved Designs

Production and fulfillment

We may use uploaded content, product configurations, previews, generated files, and design approvals to:

  • Create and revise your design;
  • Prepare production-ready files;
  • Manufacture the customized product;
  • Confirm product specifications;
  • Fulfill and deliver the order; and
  • Provide customer service, warranty support, or order-related assistance.

Employees, contractors, and production partners may access this information when reasonably necessary for these purposes.

Public marketing use

Purchasing a product or uploading a design does not automatically authorize us to publish your private photographs or identifiable custom designs for advertising, social media, promotional galleries, or other public marketing.

We will obtain separate permission before using private photographs or identifiable customer designs for public promotional purposes. If you give permission, the scope and withdrawal of that permission may be subject to the terms presented when consent is requested and applicable law.

Saving a design may generate a link that allows the design or configuration to be viewed or reopened. A sharing link may not have the same access controls as a private account. You should share such links carefully and avoid including information you do not want link recipients to view.

Saved designs are provided as a convenience and are not guaranteed to serve as permanent storage or backup. You should retain copies of original photographs and artwork.

11. International Processing and Transfers

We and our service providers, including Shopify and production, technology, fulfillment, and support providers, may process personal information in the United States, China, and other countries where those providers operate, including countries other than the country where you live. As a result, your personal information may be subject to the laws of those jurisdictions and may be accessible to courts, law-enforcement authorities, or regulatory authorities where permitted by law.

Where required by applicable law, we take appropriate measures designed to protect personal information transferred across borders. You may contact us for additional information about our international data-processing practices.

12. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Services and fulfill orders;
  • Maintain saved designs and customer accounts;
  • Provide customer service and warranty support;
  • Meet accounting, tax, recordkeeping, and legal obligations;
  • Protect the security and integrity of the Services;
  • Detect or prevent fraud;
  • Resolve disputes; and
  • Establish, exercise, or defend legal claims.

The appropriate retention period depends on factors including the nature of the information, the purpose for which it was collected, legal requirements, operational needs, and potential disputes.

Deleted information may remain temporarily in backups until the applicable backup-rotation cycle is completed or may be retained where required by law.

13. Information Security

We use reasonable organizational, administrative, and technical measures designed to protect personal information.

No method of transmission over the internet or electronic storage system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting account credentials and exercising care when sharing saved-design links.

If you believe your account, personal information, or design link may have been accessed without authorization, contact us promptly at support@uniquebowling.com.

14. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Request access to personal information we maintain about you;
  • Request correction of inaccurate information;
  • Request deletion of personal information;
  • Obtain a portable copy of certain information;
  • Withdraw consent where processing is based on consent;
  • Restrict or object to certain processing;
  • Opt out of the sale or sharing of personal information;
  • Opt out of targeted advertising;
  • Appeal certain decisions concerning a privacy request; and
  • Receive equal service without unlawful discrimination for exercising a privacy right.

These rights are not absolute. Applicable law may permit or require us to retain or continue processing certain information.

To submit a request, email support@uniquebowling.com and describe the right you wish to exercise. We may request information reasonably necessary to verify your identity and protect your information from unauthorized access or deletion.

Where permitted, an authorized agent may submit a request for you. We may ask for proof of the agent’s authority and may need to verify your identity directly.

We will respond within the period required by applicable law. If applicable law gives you a right to appeal our decision, instructions for submitting an appeal will be included in our response.

You may also have the right to complain to the data-protection or privacy authority where you live.

15. Children’s Privacy

The Services are intended for adult purchasers and are not directed to children under 13 or any higher minimum age established by applicable local law. We do not knowingly collect personal information directly from children in violation of applicable law.

An adult may purchase a customized product for a child. If an adult uploads a child’s photograph or other personal information, the adult must have the authority necessary to provide and use that content for the requested product.

If you are a parent or legal guardian and believe a child has provided personal information to us improperly, contact us so that we can review and, where appropriate, delete the information.

16. Third-Party Websites and Services

The Site may contain links to third-party websites, applications, or services. Those parties have their own privacy practices, and this Privacy Policy does not govern their independent processing.

A link to a third-party service does not mean that we control or accept responsibility for its privacy or security practices. We encourage you to review the privacy policy of any third-party service you use.

Purchases or interactions occurring on a different website may be governed by that website’s terms and privacy policy.

17. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, technology, services, legal requirements, or other operational considerations.

The “Last updated” date at the top identifies the current version. When required by law, we will provide additional notice of material changes or request renewed consent.
